You may not use this Site for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of the Nancy Lurie Marks Family Foundation (“NLMFF”) or others. Without limiting the foregoing, you may not interfere with the proper working of this Site or attempt to gain unauthorized access to any portion of this Site or any other systems or networks connected to this Site by hacking or any other illegitimate means.


Additional terms and conditions may apply to specific portions of this Site, and such terms and conditions are made a part of these Terms of Use by reference. You agree to abide by such other terms and conditions. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of this Site, the latter terms shall control with respect to your use of that portion of this Site.

NLMFF reserves the right, in its discretion, to update or revise these Terms of Use. Please check periodically for changes. All such changes to these Terms of Use are effective immediately when they are posted to this Site. Your continued use of this Site following the posting of any changes to these Terms of Use constitutes acceptance of those changes. 

ELIGIBILITY 

In using and navigating your way around this Site, you certify that you are at least 18 years of age or that your parent or legal guardian consents to your use of this Site. If you are under the age of 18, but at least 13 years of age, you may use this Site, but only under the supervision of a parent or legal guardian, who agrees to be bound by these Terms of Use. If you are a parent or legal guardian agreeing to these Terms of Use for the benefit of a child between the ages of 13 and 18, be advised that you are fully responsible for your child’s use of this Site, including all legal liability that your child may incur.

NLMFF does not knowingly collect personal information about children under the age of 13 without prior parental consent. Children under the age of 13 may not use this site for anything other than for browsing.

Please note that if you are under age 18 and are choosing to submit a Story to this Site, a parent or guardian must agree to the provided consent form on your behalf before submission. Similarly, if you are age 18 or older but have a legal guardian, then your guardian must agree to the consent form on your behalf.

NLMFF grants you a limited, non-exclusive license to download, print and make a reasonable number of copies of the content and materials available on this Site solely for your personal, non-commercial use or for educational purposes, provided you keep intact all copyright and other proprietary notices and do not copy or post the content and materials on any network computer or publicly display or distribute the content and materials in any media. USER CONTRIBUTIONS

This Site may contain interactive features (“Interactive Services”) that allow users to post, submit, publish, display, or transmit to NLMFF or to other users or other persons (hereinafter, “post”) content or materials (collectively, “User Contributions”) on or through this Site. You represent and warrant that (i) you own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our licensees, successors, and assigns, if applicable; and (ii) you understand and acknowledge that you are responsible for your User Contributions, and you, not NLMFF, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness. If you use the “Submit Your Story” feature of this Site, you must agree to and accept the terms of the Autism Around the Globe Consent Form (“Consent Form”), which governs the submission of written and/or graphic materials (including narrative text, photographs, and/or video recordings) (a “Story”) to the Autism Around the Globe project and supplements these Terms of Use.  In the event of any conflict between these Terms of Use and the Consent Form with respect to a Story, the Consent Form will control.

You agree not to use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any User Contributions you submit. You are and will remain solely responsible for the content of any User Contributions you make, and you agree to indemnify NLMFF and its affiliates for all claims resulting from any User Contributions you submit. We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of this Site. You further agree that no User Contributions submitted by you to this Site will be or contain libelous or otherwise unlawful, threatening, abusive, or obscene material, nor will such content contain software viruses or other malware, political campaign messages, commercial solicitations, chain letters, mass mailings or any form of “spam.”

Except as otherwise stated in these Terms of Use, any User Contribution you post to this Site will be considered non-confidential and non-proprietary, and, by providing any such User Contribution on this Site, you authorize NLMFF to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display, and distribute your User Contributions for any purpose whatsoever, without restriction and without compensating you in any way. NLMFF is and will be under no obligation to (1) maintain any User Contributions in confidence; (2) pay users any compensation for any of their User Contributions; or (3) respond to any User Contributions.

NLMFF reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with NLMFF in asserting any available defenses.  
 
INTERNATIONAL USE  
NLMFF makes no representation that materials on this Site are appropriate or available for use in locations outside the United States, and accessing them is prohibited in territories where viewing or downloading their content is in violation of local law. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws.

CHOICE OF LAW AND FORUM  
These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of this Site will be the state or federal courts located in the Commonwealth of Massachusetts, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.  

SEVERABILITY AND INTEGRATION  
Unless otherwise specified herein, these Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and NLMFF with respect to this Site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and NLMFF with respect to this Site.
